MACT awards ₹19 lakh to family of cyclist killed in 2019 mishap

The motorcycle driver initially contested the claim, alleging negligence by the deceased. He failed to produce evidence and later stopped appearing before the tribunal. The court proceeded ex parte, with eyewitness testimony and the deceased’s wife’s testimony remaining unchallenged.

The order provides for 9% per annum interest from the date the petition was filed until realization.

The compensation amount is to be distributed among the widow and the couple’s three children, with a portion earmarked for fixed deposits in the minor children’s names to secure their future. The respondent was directed to deposit the awarded amount within three months.

The offending motorcycle was not insured at the time of the accident. Consequently, the insurance company was removed from the case, and the entire liability to pay compensation was placed on the driver.

The tribunal computed the sum by applying the Supreme Court’s principles, accounting for the deceased’s monthly income (₹16,675), future prospects, deductions for personal expenses, loss of dependency, and conventional heads such as loss of consortium, funeral expenses, and loss of estate.

The Motor Accident Claims Tribunal awarded ₹19 lakh in compensation to Pinki Tiwari and her three children, holding the driver solely responsible for the fatal accident.

Dinesh Tripathi, a resident of Ram Darbar, was riding a bicycle when he was struck by a speeding motorcycle near the Centra Mall light point in the Industrial Area, Phase 1. He sustained grievous injuries and died later during treatment at PGI; an FIR was registered at the Industrial Area police station.
