HC Allows State to Reassess Disabilities of Employees Amid Bogus Claims

The Bombay High Court disposed of the petitions by ruling that the state has the authority to undertake a re-verification process. It directed all remaining PwD employees to undergo medical examinations before expert panels or opt for voluntary retirement after tendering an affidavit of apology. Those found with bogus certificates or UDID cards, or with disabilities up to 10% on reassessment, should be compulsorily retired after departmental inquiries. Employees with benchmark disabilities of 11%–39% should not be given service benefits thereafter. The court struck down the government’s orders suspending PwD category employees, stopping salaries, cancelling recruitment approvals for teachers, and transferring them, and quashed FIRs against some employees for allegedly using false disability certificates.

The Maharashtra government issued a Government Resolution in June 2025 directing all state departments to verify the disability of employees who had secured jobs through the PwD quota or were receiving PwD-category benefits as a one-time measure.
